1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the PLASTIC BOTTLES LLC website and services. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

2. Products and Services

PLASTIC BOTTLES LLC manufactures and distributes plastic bottles, containers, closures, and related packaging products. Product specifications, images, and descriptions on our website are for informational purposes. We strive for accuracy but do not guarantee that all information is complete or error-free.

We reserve the right to modify, discontinue, or update products at any time without notice. Colors may vary slightly from images due to monitor settings and manufacturing variations.

3. Orders and Pricing

Quotes and Pricing

All quotes are valid for 30 days unless otherwise specified. Prices are subject to change without notice. Quoted prices do not include shipping, taxes, or duties unless explicitly stated.

Order Acceptance

All orders are subject to acceptance by PLASTIC BOTTLES LLC. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or credit concerns.

Minimum Order Quantities

Many products have minimum order quantities (MOQs). MOQs vary by product type and customization level. Contact our sales team for specific requirements.

4. Payment Terms

Payment terms are established at the time of order. Standard terms for new customers require 50% deposit with the balance due before shipping. Established customers may qualify for net terms (Net 30) upon credit approval.

We accept major credit cards, wire transfers, and ACH payments. Late payments may be subject to interest charges of 1.5% per month or the maximum rate permitted by law.

5. Shipping and Delivery

Shipping dates are estimates and not guaranteed. PLASTIC BOTTLES LLC is not liable for delays caused by carriers, weather, customs, or other factors beyond our control.

Risk of loss and title transfer to the buyer upon delivery to the carrier (FOB Origin) unless otherwise agreed in writing. Customers are responsible for inspecting shipments upon receipt and reporting any damage or discrepancies within 48 hours.

6. Returns and Refunds

Standard stock products may be returned within 30 days of delivery for credit, subject to a 15% restocking fee. Products must be unused, in original packaging, and in resalable condition. Return shipping is the customer's responsibility.

Custom products, decorated items, and special-order products are non-returnable unless defective. Claims for defective products must be made within 10 days of receipt.

7. Warranty

PLASTIC BOTTLES LLC warrants that products will conform to agreed specifications and be free from defects in materials and workmanship at the time of delivery. This warranty extends for 12 months from the date of delivery.

Our sole liability under this warranty is limited to replacement of defective products or refund of the purchase price, at our discretion. We are not liable for consequential, incidental, or special damages.

This warranty does not cover damage caused by misuse, improper storage, incompatible contents, or failure to follow recommended guidelines.

8. Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of PLASTIC BOTTLES LLC and protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without written permission.

Custom tooling and molds developed by PLASTIC BOTTLES LLC remain our property unless otherwise agreed in writing with appropriate compensation.

9. Limitation of Liability

To the maximum extent permitted by law, PLASTIC BOTTLES LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities.

Our total liability for any claim shall not exceed the amount paid by you for the products giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless PLASTIC BOTTLES LLC, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our products or violation of these Terms.

11. Force Majeure

PLASTIC BOTTLES LLC shall not be liable for failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, labor disputes, supply chain disruptions, or government actions.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Florida.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our website or services after changes constitutes acceptance of the modified Terms.
